Posting Specifics
Employers must display the applicable posters at worksites or jobsites in areas where they will be seen by all employees.
1CalChamber’s 24” x 18” Berkeley Fair Workweek Poster (English, Spanish and Simplified Chinese combined) contains the official employment notices required by Berkeley for every employer covered by the City of Berkeley Fair Workweek Ordinance who has 10 or more employees in Berkeley and is:
- Primarily engaged in the building services, healthcare, hotel, manufacturing, retail, or warehouse services industries, and employs 56 or more employees globally; or
- Primarily engaged in the restaurant industry, and employs 100 or more employees globally; or
- A franchise primarily engaged in the retail or restaurant industries and is associated with a network of franchisees employing in the aggregate of 100 or more employees globally; or
- A not-for-profit corporation organized under Section 501 of the United States Internal Revenue Code in the building services, healthcare, hotel, manufacturing, retail, restaurant, or warehouse industries, and employees 100 or more employees globally.
A covered employee must perform at least two hours of work in a calendar year within the geographic boundaries of Berkeley for a covered employer; must qualify as an employee entitled to payment of a minimum wage under the California minimum wage law (Labor Lode Section 1197 and wage orders published by the California Industrial Welfare Commission; and is an employee who is not exempt from payment of any overtime rate of compensation pursuant to Labor Code Section 510 and not paid a monthly salary equivalent to at least forty hours per week at a rate of pay twice the Berkeley minimum wage.
