Compliance Alert: CalChamber's 2024 poster reflects Berkeley’s new minimum wage of $18.07/hour that took effect on July 1, 2023. This requires an updated posting since that date.
Note: Employers who fail to comply with Berkeley posting requirements and local employment laws may be subject to administrative citations, penalties and civil actions.
Covered Employers
If you are an employer with one or more employees performing at least two hours of work in a week within the geographic boundaries of the City of Berkeley, you are required to post Berkeley’s official notice, even if some of the ordinances listed on the notice are not applicable to you.
Required Notices
CalChamber’s 24” x 14” Berkeley Labor Law Poster (English, Spanish and Chinese combined) contains these official employment notices required by the City of Berkeley ordinances:
- Berkeley Minimum Wage - All employers with one or more employees performing at least two hours of work in Berkeley in a calendar week
- Berkeley Paid Sick Leave - All employers with one or more employees performing at least two hours of work in Berkeley in a particular week
- Berkeley Family Friendly and Environment Friendly Workplace - All employers with 10 or more employees performing working in Berkeley
Every employer must post this notice in a conspicuous place at the workplace or jobsite where any employee works.
Posting Specifics
Employers covered by the minimum wage and paid sick leave ordinances must post them in any language spoken by at least 5 percent of employees at a workplace or job site. Employers covered by the Family Friendly and Environment Friendly Workplace Ordinance must post in English, Spanish, Chinese and any language spoken by at least 5 percent of employees at a workplace or jobsite.
