Compliance Alert: CalChamber's poster reflects Berkeley’s new minimum wage of $18.67/hour that takes effect on July 1, 2024. This requires an updated posting for all employers on that date.
A new posting, the 2024 Berkeley Fair Workweek Poster reflects the City of Berkeley Fair Workweek Ordinance that took effect on January 12, 2024, and applies to certain employers. (See details below.1)
Note: Employers who fail to comply with Berkeley posting requirements and local employment laws may be subject to administrative citations, penalties and civil actions.
Required Notices
Based on your industry, purchase the following Berkeley mandatory postings:
- For all employers:
(1) Berkeley Labor Law Poster - For certain employers primarily engaged in the building services, healthcare, hotel, manufacturing, warehouse services, retail, or restaurant industries, with 10 or more employees1 within the City of Berkeley:

Posting Specifics
Employers must display the applicable posters at worksites or jobsites in areas where they will be seen by all employees.
Covered employers must post notices informing employees of their rights under these ordinances:
CalChamber’s 24” x 14” Berkeley Labor Law Poster in English, Spanish and Chinese combined contains these official employment notices required by the City of Berkeley ordinances:
- Berkeley Minimum Wage - All employers with one or more employees performing at least two hours of work in Berkeley in a calendar week
- Berkeley Paid Sick Leave - All employers with one or more employees performing at least two hours of work in Berkeley in a particular week
- Berkeley Family Friendly and Environment Friendly Workplace - All employers with 10 or more employees performing work in Berkeley
These notice obligations apply to all employers with one or more employees performing at least two hours of work in a week within the geographic boundaries of the City of Berkeley. You are required to post Berkeley’s official notice, even if some of the ordinances listed on the notice do not apply to you.
Employers covered by the minimum wage and paid sick leave ordinances must post them in any language spoken by at least 5 percent of employees at a workplace or jobsite. Employers covered by the Family Friendly and Environment Friendly Workplace Ordinance must post in English, Spanish, Chinese and any language spoken by at least 5 percent of employees at a workplace or jobsite.

1CalChamber’s 24” x 18” Berkeley Fair Workweek Poster in English, Spanish and Simplified Chinese combined contains the official employment notices required by Berkeley for every employer covered by the City of Berkeley Fair Workweek Ordinance who has 10 or more employees in Berkeley and is:
- Primarily engaged in the building services, healthcare, hotel, manufacturing, retail, or warehouse services industries, and employs 56 or more employees globally; or
- Primarily engaged in the restaurant industry, and employs 100 or more employees globally; or
- A franchise primarily engaged in the retail or restaurant industries and is associated with a network of franchisees employing in the aggregate of 100 or more employees globally; or
- A not-for-profit corporation organized under Section 501 of the United States Internal Revenue Code in the building services, healthcare, hotel, manufacturing, retail, restaurant, or warehouse industries, and employees 100 or more employees globally.
A covered employee must perform at least two hours of work in a calendar year within the geographic boundaries of Berkeley for a covered employer; must qualify as an employee entitled to payment of a minimum wage under the California minimum wage law (Labor Lode Section 1197 and wage orders published by the California Industrial Welfare Commission; and is an employee who is not exempt from payment of any overtime rate of compensation pursuant to Labor Code Section 510 and not paid a monthly salary equivalent to at least forty hours per week at a rate of pay twice the Berkeley minimum wage.
